It looks like Jack Smith’s high-stakes legal crusade against Donald Trump has ended not with a bang but with a whimper. The Special Counsel, a little after two years of relentless pursuit, has thrown in the towel on the federal Jan. 6th charges, filing a motion to drop all charges against the now- President-elect.
Smith cited constitutional requirements preventing the prosecution of a sitting president as the rationale. His case was supposed to be the pièce de résistance in the Justice Department’s quest to stop Trump in his tracks from ever becoming president again. EPIC FAIL, deep state.
Instead, the case has unraveled like a poorly constructed house of cards after Orange Man Bad won the presidency. Despite piling on four felony charges – conspiracy to defraud the U.S., obstruction of an official proceeding, conspiracy to obstruct, and conspiracy against rights – the case didn’t reach trial in time to throw the Trumpster in jail.

And so…the Jan. 6th election interference case was dismissed without prejudice and even though Donald Trump Jr. said on the Laura Ingraham show on Monday evening that the case is over, Ingraham says she is skeptical that the Democrats will give it up and will somehow figure out a way to get around the statute of limitations in 2029 when Trump leaves office.
Document case goes down the drain too.
Smith thew in the towel on the classified documents case too and will not appeal the ruling from U.S. District Judge Aileen Cannon (who dismissed the case ruling that Smith’s appointment as a Special Counsel was unconstitutional.) Smith also cites his reasoning for this as being the DOJ’s policy against prosecuting a sitting president.
The case centers on allegations that Trump improperly retained and mishandled classified and sensitive government documents after leaving office in January 2021. Under the Presidential Records Act, such materials are required to be transferred to the National Archives and Records Administration at the end of a president’s term.
Did the Biden DOJ care that Old Man Joe had a bunch of documents in his garage unsecured? Nope. They said that Biden had a poor memory so he’s safe. The deep state only cares what Republicans do (especially Trump). Does that mean Trump’s DOJ can go after Biden after he leaves office in 2025? I hope so. And I hope they do. There are a LOT of Democrats, including Biden, who need to be investigated and prosecuted and I’m fine with Trump using a lot of new MAGA staff and my tax money to do it.
What’s next for the other cases against the President-elect?
While Smith closes up shop on the Trump cases, the Donster’s legal troubles aren’t entirely behind him. State-level cases in New York and Georgia remain possible live grenades. The RICO case in Georgia accuses him of election meddling and is effectively on hold. It will probably be kept in the Dem’s back pocket until 2029.
The case in New York is about alleged hush-money cover-ups. Trump’s sentencing has been delayed in New York which means they’ll most likely pick it up again when he leaves office if the judge doesn’t dismiss the whole thing before that.
If the left can “get” Trump, they’ll do everything in their power to do so – or at least spend all of their time and energy trying – whether that means now or in the future.

Trump said on his Truth Social Account about the two dismissed cases, “These cases, like all of the other cases I have been forced to go through, are empty and lawless, and should never have been brought. Over $100 Million Dollars of Taxpayer Dollars has been wasted in the Democrat Party’s fight against their Political Opponent, ME. Nothing like this has ever happened in our Country before…”
Trump has the winning hand.
Jack Smith’s retreat marks yet another failed chapter in the deep state’s relentless war against Donald Trump, leaving the Democrats scrambling, very very mad and crying. With the federal cases dismissed and the once-mighty Special Counsel closing up shop (and soon to be fired), Trump has emerged not just unscathed but emboldened, turning what was meant to be his undoing into a rallying cry for his supporters.
