For years, some Americans have light up a joint legally under state law, paid taxes on marijuana products, but then immediately became “too dangerous” to own a firearm in the eyes of the federal government.
Now that may finally be changing.
According to a report in the Hemp Gazette, the ATF (the Bureau of Alcohol, Tobacco, Firearms and Explosives) is proposing updates to its federal firearm purchase form that acknowledge the Trump administration’s move to reclassify medical marijuana under federal law. The change could eventually open the door for some marijuana users to legally own guns without automatically failing the infamous background check question about “unlawful” drug use.
The issue is also heading toward a possible Supreme Court showdown as courts wrestle with whether occasional marijuana use should permanently block someone from exercising Second Amendment rights.
