A white Virginia man was charged with multiple misdemeanor counts of brandishing a firearm, which he pointed at four black men on bikes who the suspect said were on “private property.”

According to a Reddit post, the men claimed they had “pulled into the neighborhood where 3 of the guys grew up and stopped at the cul-de-sac to stretch and plan our route home. This guy came walking down his driveway with his weapon aimed at us the entire time. Police were called and he has been arrested for brandishing. Be careful out there. It’s a crazy world we live in.'”

News flash people. You can’t be arrested for trespassing without being formally cited for trespassing once before.

All the cops would do is give them a ticket and let them go. But if they ever come back then the police will have the authority to arrest them. This does not apply to businesses that are closed, that would be criminal trespassing and or breaking and entering.

Video emerged online Monday that showed Dennis Lee Berry, 45, pointing a rifle at four black bikers as they took a break during a ride through his neighborhood. The Spotsylvania County Sheriff’s Office later issued a statement saying the bikers overlooked a “Private Road No Trespassing” sign.

Berry, who is not related to a local retired sheriff’s deputy with the same name, was later charged with five misdemeanor counts of brandishing a firearm after a current sheriff’s deputy arrived on the scene. A heated dispute took place off Whelan Way near Partlow, Virginia, officials confirmed to Newsweek Tuesday, during which the four black bikers repeatedly questioned why Berry needed to threaten their lives with a firearm instead of just asking them to ride further down the road.

The Spotsylvania Sheriff’s Office clarified Tuesday that Berry was charged because “the male parties were unarmed and not on HIS private property.”

Berry was arrested and released on his own recognizance. Brandishing a weapon in Virginia is a Class 1 misdemeanor that carries a maximum penalty of one year in jail and a $2,500 fine.
