D.C. District Judge Emmet Sullivan seems to be completely out of his mind. Safe to say, this is NOT the typical response to a prosecutorial request for a dismissal.
Judge Sullivan has now appointed a retired judge to look into “whether the Court should issue an Order to Show Cause why Mr. Flynn should not be held in criminal contempt for perjury.” Thus, the court is not only considering denying an uncontested motion for dismissal but…

[Townhall] Ex-National Security Adviser Michael Flynn’s war with the government isn’t over just yet. He scored a decisive win, with the Department of Justice filing a motion to dismiss the bogus “lying to the FBI” charges against him. Charges that were politically motivated, part of an elaborate and expansive FBI plot to entrap the former top Trump official. James Comey and Andrew McCabe were out to get Flynn no matter the cost. Department policy and the Constitution be damned; they were going to him.
Flynn was the target of the FBI’s counterintelligence probe into Russian collusion because he spoke with the Russians…because that’s what incoming national security advisers do. That’s their job. In the end, there was no evidence of collusion—nothing. There was no evidence to even target Flynn in a counterintelligence probe. And yet, the anti-Trump elements at the DOJ proceeded anyway. The FBI was running amok.
Now, even as Flynn is closer to total and complete victory, the judge presiding over the case, Judge Emmett Sullivan, a Clinton-era appointee, is gumming up the works. As Beth wrote last night, he’s allowing amicus briefs to be filed from the most viciously anti-Trump elements in our legal system in opposition to the DOJ motion.
You don’t understand. The FBI and DOJ committed Perjury to indict the General. Wing Man Holder’s law Firm committed Perjury by withholding critical information from the General and advised him to plead guilty. Then the General, to save his son from prosecutors who threatened to commit Perjury to indict the son, and on notify of corrupt counsel admitted that he had done what he had not, is guilty of Perjury, committed by everyone but him. That is how despots roll.
This judge has no shame and no character. He is a political hack and a closet member of the “Resist Movement.” He is simply trying to queue up another hackneyed political hatchet job against Flynn.

Sullivan is, unsurprisingly, a Clinton judge. Barr needs to remind him that he is still subject to judicial misconduct review and can be removed. Note United States v. Fokker.
This whole thing stinks to high heaven. Individual acts perpetrated by the Obama administration are punishable by up to ten years in prison. But it is worse than that because this is really about a conspiracy to engage in sedition against a duly elected administration.
