Here we go again…
Judge Napolitano is taking another veiled jab at President Trump by actually defending Schumer’s threats against the president’s two SCOTUS appointees.
On Thursday’s “Fox & Friends” the #NeverTrump judge said that Schumer’s words were “excessive,” but not a threat and that he’ll “defend to the death” Schumer’s right to personally attack Supreme Court justices.
Napolitano said, “No, I don’t think legally it was a threat. It was hyperbolic. It was [an] excessive use of words, and it was an attempt to intimidate, but it’s protected speech. A threat, where you have the present, apparent ability to cause the harm you are threatening is not protected speech, but this is.”
He continued, “However, this effort to politicize the court, to make them look like they can be intimidated by a mob outside of the courthouse, is very, very dangerous to our system. We put in the hands of nine human beings the ability to decide what the laws mean and what the Constitution means, and we accept those decisions because they have the moral authority to make them. When we begin to look at them as politicians in black robes, instead of as the nine, it undermines respect for law, and that’s the danger from what Senator Schumer said.”
He added, “This is protected speech. I condemn what Schumer said, but will defend to the death his right to say it, but it is dangerous speech if more people pick up on it.” [Breitbart]
Good grief…
This guy will literally jump on anything in an effort to undermine Trump.
He’s among only the few who are actually defending Schumer’s outlandish threats as even Nancy Pelosi condemned them.
House Speaker Nancy Pelosi called it “unfortunate” that Democratic New York Sen. Chuck Schumer issued a warning to Supreme Court Justices Brett Kavanaugh and Neil Gorsuch.
“I believe he also said on the floor today that his words were not appropriate, and I support him in that,” the California Democrat told reporters on Thursday. “It’s unfortunate because, as you see, I think the Republicans say, ‘It’s okay if the president does it, but it’s not okay if other people do it.’ It wasn’t right for anybody to do it, and Chuck recognized those words.” [Washington Examiner]
It’s sad that even senile Pelosi can see the error in Schumer’s words, but Napolitano cannot.
Clearly he’s working overtime to get a primetime spot on MSNBC with this nonsense.
