When Democrats aren’t parading around, trying to convince America that its only savior is Joe Biden, they are busy tearing at the very fabric of society. Their latest victim happens to be the prison system as the Democratic Governor of California Gavin Newsom passed a new law allowing inmates to be put in prisons based on their gender identity.

Before the new law was signed, inmates at the California Department of Corrections and Rehabilitation were placed in cells depending on their biological sex. This was to protect female inmates from becoming victims of sexual assault or worse. As for transgenders, they were also housed due to their biological sex rather than their preferred sex for safety reasons.

The Transgender Respect, Agency, and Dignity Act changes the entire prison intake system. Now when an inmate is taken in, officers will have to privately ask them what they identify as. According to the new law, a person can identify as a nonbinary, intersex, or transgender when placed in intake.

The author of the bill, Democratic Senator Scott Wiener, believes it will help protect transgenders who have fallen victim to being placed in a cell due to biological sex. He said, “It’s just a false narrative about transgender people and about transgender women in particular that they’re somehow not really women and are just trying to scam their way into women’s bathrooms or facilities in order to do bad things. Overwhelmingly the people who are being victimized are trans people.”

While the new law has caused controversy within the prison system, the California Department of Corrections and Rehabilitation still holds majority of the power when placing inmates. The department can still deny an inmate their request of a preferred prison, but if denied, the department must give the inmate a written reason behind the decision and ample opportunity to object.

Still, opponents of the new law, like Republican Chris Bish, says the law will ultimately put biological women in danger from inmates who manipulate the system. His main defense is that women will be put into dangerous situations given the new law, especially when it comes to sexual assault.

Although a hot topic, the law isn’t that new as states like Connecticut, Massachusetts, New York, and Rhode Island have all had similar laws where inmates were placed in prisons due to gender identity rather than biological.
