NJ Woman Arrested And Charged With Organizing Protest Against Governor’s Stay-At-Home Order

Kim Pagan of Toms River, NJ, was charged with violating the emergency orders for organizing a protest against Gov. Phil Murphy’s stay-at-home executive orders in Trenton, according to the New Jersey Office of the Attorney General.

I wonder what it will look like if she fights it in court. The governor did say publicly that the Constitution was “above his paygrade.”

Pagan and her protesters are libertarians and claimed not to be Republican or Democrat.

A woman was charged Friday for organizing a protest in Trenton of the stay-at-home orders instituted last month by Gov. Phil Murphy to help slow the spread of the coronavirus in New Jersey.

Kim Pagan, of Toms River was charged by the New Jersey State Police with violating the emergency orders, according to a release from New Jersey Attorney General Gurbir S. Grewal and Colonel Patrick J. Callahan, Superintendent of the New Jersey State Police.

The protestors gathered outside the Statehouse and other locations in Trenton on Friday afternoon as Murphy and state health officials held their daily coronavirus press briefing.

A video taken by a woman who was live streaming the protest on Facebook showed people driving by the Statehouse honking their horns with American flags waving from their windows and others holding signs and flags on the sidewalk in front of the building.

If I was the judge and this case was brought before me, my first question would be, “Is there a legislated penalty for the particular offense of coordinating a protest during a stay at home order during a pandemic? No? Very well, then. I impose the maximum penalty allowed by law of – absolutely no time incarcerated and no fine.

Now, Mr. District Attorney, get out of my courtroom before I have you arrested for contempt – which the law says I get to define in my courtroom.”
