A Massachusetts judge, indicted for allegedly helping sneak an illegal alien out of a courtroom to avoid an Immigration and Customs Enforcement agent, is opting to fight the charges instead of accepting a plea deal.

Newton District Court Judge Shelley Richmond Joseph was offered a deal to avoid prosecution if she admitted she helped an illegal immigrant escape out a basement door in the courthouse to avoid ICE agents last year, the Herald has learned.

The deal that Joseph turned down was offered up by U.S. Attorney Andrew Lelling’s office, a source familiar with the matter told the Herald.

Joseph, 51, of Natick, was indicted last month on federal charges of obstruction of justice and aiding and abetting for allegedly interfering with a federal investigation. The state Supreme Judicial Court quickly announced it had suspended Joseph without pay, effective immediately. She was earning $184,694 a year.

In addition to Joseph, the grand jury indicted former $83,344-a-year Trial Court officer Wesley MacGregor, 56, of Watertown, on charges of obstruction of justice and aiding and abetting, as well as perjury.

Joseph and MacGregor have both pleaded not guilty and Judge Jennifer Boal released them both on their own recognizance.

I hope the prosecution is top-notch because Joseph, by choosing to go to trial, must believe she can be acquitted. There’s a vast difference between a Federal Court and a State Court. She got too comfortable being a part of the corrupt Massachusetts Justice System. She doesn’t want to serve any federal time, not that I can blame her for that sentiment.

Don’t you find it interesting that in the indictment, the defense lawyer for the illegal immigrant, in this case, was referred to as having conspired with the Judge and the Court Officer to get his client out the back door of the courthouse? Yet the defense lawyer was not indicted?

This means the defense lawyer is a “cooperating witness” who has been given immunity in return for testimony. On the merits, the Judge and the Court Officer should be found guilty. If the Judge gets off on the technicality of the Absolute Immunity defense, she still should lose her job based on her violation of the court rules when she ordered the recording system to be shut off while she consummated the conspiracy with the defense attorney and the court officer.

I hope the evidence supports the charge and that the jury is as tired as are the rest of us of activist judges who believe they are above the law. The judiciary should reign in because it is running amuck. The left-wing ideology they embrace has thoroughly corrupted their ability to render decisions based upon the law.

They have become power-hungry progressive activists. Disbar a few and send them to jail, and they will quickly learn that the law supersedes their personal beliefs. No one is above the law, not even our black-robed betters.
